Some factors the parties to a lawsuit will look at to help determine the value of a case are the seriousness of the injuries suffered, the type and length of medical treatment involved, the out-of-pocket losses such as the cost of past and future medical expenses, your lost wages, any loss or impairment of the ability to earn a living in the future, and your property damage. These are fairly easy to calculate because they are objectively verifiable monetary losses. These are termed special damages.
General Damages
General damages are also available to an injured person. These damages compensate the injured party for their pain and suffering, loss of enjoyment of life, as well as any mental or emotional upset. There is no set in stone formula for calculating these losses. It is up to your attorney to argue your personal injury case and request both general and special damages.
